Personal Information Information We May Collect
Personal Information means any information that may be used to identify an individual, including, but not limited to, a first and last name, a home or other physical address, a phone number, an email address, credit card information, payment information, and billing address. In general, you can visit the Site without telling us who you are or revealing any Personal Information about yourself. However, in order to access certain information, services, or features that may be contained on the Site, we may require you to provide Personal Information. For example, we will collect certain Personal Information if you choose to subscribe to a mailing list, register for an account, participate in special offers, sweepstakes or other promotions, sign up for our chat rooms, message boards or blogs, or send questions or comments to us via e-mail. If you would like to purchase any products or merchandise offered for sale on the Site using a credit card, we also will collect your credit card information and a shipping address.
For some features of the Site, you may be able to submit information about other people. For example, if you wish to purchase a product for another person on the Site and want it shipped directly to that person, you may submit the recipient's name, address and certain other contact information. We will use and store any such information that we collect from you about another person only to the extent necessary to carry out your request, and we will not use such information for any other purpose.
How We May Use Your Information
If you provide us with Personal Information, we may retain and use that information for several purposes. For example, we may use your Personal Information in order to process and fulfill any transactions or services that you request, such as sending daily e-mail inspirations you sign-up for on the Site, products or merchandise that you purchase on the Site (including any customary follow-up or confirmation communications regarding such transactions), entering you into a sweepstakes, establishing an account for you, responding to your questions, or sending e-mails to our mailing list subscribers. We may also use Personal Information to ensure compliance with our policies and applicable law. In addition, we may send you periodic communications by e-mail or regular mail, such as news updates, special offers or information on our products or services, if you have chosen to receive such communications. If you later wish to opt-out of receiving such promotional e-mails from us at any time, simply follow the instructions for doing so in the e-mails that you receive from us. We reserve the right to send you certain communications relating to the Site, such as service announcements, e-mails related to purchases you have made, or similar administrative or transactional messages, without offering you the opportunity to opt-out of receiving them.
With Whom We May Share Your Information
We may sometimes use other businesses to perform certain services for us, such as maintaining the Site and our mailing lists, processing orders and delivering products, sending postal mail, and providing marketing assistance and data analysis. We may provide Personal Information to those businesses when that information is necessary for them to complete a requested transaction or otherwise perform their duties. Josie Maran Cosmetics will take reasonable steps to ensure that these third-party service providers are obligated to protect Personal Information on Josie Maran Cosmetic's behalf.
You may also have given us permission to send you information regarding products which we may believe may be of interest to you.
As Josie Maran Cosmetics develops, we may buy other businesses or their assets or sell our business assets. Customer information is generally one of the business assets involved in such transactions. Thus, in the event that Josie Maran Cosmetics or all of its assets are acquired, customer information would be one of the transferred assets.
We reserve the right to disclose visitor information in special cases when we have reason to believe that disclosing this information is necessary to identify, contact, or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) our rights or property, other visitors, or anyone else that could be harmed by such activities. We also reserve the right to disclose visitor information when we believe in good faith that the law requires it.
From time to time, we may collect general, non-personal, statistical information about the use of the Site, such as how many visitors visit a specific page on the Site, how long they stay on that page and which hyperlinks, if any, they "click" on. We collect this information in order to determine which areas of the Site are most popular and to enhance the Site for visitors. However, please be assured that this aggregate data will in no way personally identify you or any other visitors to the Site.
Cookies and Other Tracking Technologies
Tracking technologies may record information such as Internet domain and host names; Internet protocol (IP) addresses; browser software and operating system types; clickstream patterns; and dates and times that our Site is accessed. An IP address is a number that is automatically assigned to your computer whenever you are surfing the web. Web servers, the big computers that "serve up" webpages, automatically identify your computer by its IP address. It is not our practice to link the information we record using tracking technologies to any Personal Information you submit while on the Site. However, we reserve the right to use IP addresses and other tracking technologies to identify a visitor only when we feel it is necessary to enforce compliance with the Site's policies, to protect the Site, our customers, or others, or when we believe in good faith that the law requires it.

We intend to take reasonable and appropriate steps to protect the Personal Information that you share with us from unauthorized access or disclosure. The security of your Personal Information is important to us. We maintain physical, electronic, and procedural safeguards to secure your personal information. However, there is some risk in transmitting information electronically. We cannot guarantee the security of our databases, nor can be guarantee that information you supply won't be intercepted while being transmitted to us over the Internet. By supplying us with information, you acknowledge these risks and signify that you have voluntarily chosen to provide the information despite the inherent risks involved. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your Personal Information and privacy, we cannot guarantee or warrant the security of any information you disclose or transmit to us online and cannot be responsible for the theft, destruction, or inadvertent disclosure of your Personal Information.
If you create an account on the Site, you may be asked to choose a password for your account, in which case your online account information shall be protected by your password. We recommend that you do not disclose your password to any other person. You are responsible for maintaining the confidentiality of your password and account, and are fully responsible for all activities that occur under your password or account.
This Site is not intended for use by children under 18. We do not knowingly collect Personal Information from anyone under 18 years of age. If we become aware that we have unknowingly collected Personal Information from a child under the age of 18, we will make commercially reasonable efforts to delete such information from our database.
The California Consumer Privacy Act (the “CCPA” or “Act”) provides California residents with specific rights regarding their personal information. It should be noted that personal information under the Act does not include publicly available information from governmental records and de-identified or aggregated consumer information. This section describes your rights under the Act and explains how to exercise those rights.
Right to Personal Information
As required by the Act, we will provide you the following information upon a verifiable consumer request: (1) categories of Personally Identifiable Information that we collect; (2) categories of sources from which the Personally Identifiable Information is collected; (3) the purpose of collecting such Personally Identifiable Information; (4) the categories of third parties with whom we share Personally Identifiable Information; and (5) specific pieces of Personally Identifiable Information collected. If we sold or disclosed your Personally Identifiable Information for a business purpose in the preceding 12 months, we will provide (a) a list of the categories of personal information that was sold, and (b) a list of the categories of personal information that was disclosed for a business purpose.
Right to Request Deletion of Personal Information
According to the Act, you may request that your Personally Identifiable Information be deleted. We will comply with this request once we are able to confirm that we received a verified consumer request. Please be advised that we may deny your request to delete your Personally Identifiable Information if we need to maintain your Personally Identifiable Information in order to (1) complete a transaction, provide service or goods, or perform a contract for which the Personally Identifiable Information is collected; (2) detect any security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for these activities; (3) debug products and to identify and repair errors that impair functionality of the Service or Website; (4) exercise free speech, ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided by law; (5) comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 seq.); (6) engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent; (7) enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us; (8) comply with a legal obligation; or (9) otherwise use your Personally Identifiable Information, for internal use only, that is compatible with the context in you provide the Personally Identifiable Information.
Exercising your CCPA Rights
To request (a) information about your Personally Identifiable Information collected or (b) deletion of your Personally Identifiable Information, please visit our CCPA compliance page here or by email to customer service.
We can only respond to verifiable consumer requests. A verifiable consumer request means a request that is made by a consumer, by a consumer on behalf of a consumer’s minor child, or a person registered with the California Secretary of State that is authorized to act on your behalf. Your verifiable consumer request must include (1) sufficient information that allows us to verify your identity or provides sufficient authority to make the request; and (2) describes your request with enough detail to evaluate and respond to your request. We will not respond to any requests if we cannot verify your identity or authority to make the request and confirm that the personal information belongs to you. You are not required to create an account in order to make a verifiable consumer request. We are not required to comply with more than two verifiable requests from the same consumer in a 12-month period of time.
Please allow 45 days to complete your request. We will inform you if more time is required to complete, but it should take no longer than 90 days. if you have an account, we may provide our response to your account. If you do not have an account, we will provide our response according to your requested format, namely, electronically or by mail. Please note that there is no charge for making a request, but we reserve the right to charge a fee if the request is deemed excessive, repetitive, or manifestly unfounded. We will notify you of any fee and reasons for such fee before completing your request.
Right to Opt-out of the Sale of Personal Information.
According to the Act, you have the right to opt-out of the sale of your Personally Identifiable Information. We do not sell, share, or disseminate any Personally Identifiable Information to any third party.
We will not discriminate against you because you exercised your rights under the CCPA including: (1) denying goods or services; (2) charging different prices or rates for goods or services through discounts, benefits, or imposing penalties; (3) providing different level of quality of goods or services; or (4) suggesting that you will receive a different price, rate, quality, or level of goods or services.
Please note that if you do exercise your CCPA rights, you may not be eligible to receive discounts, cash back rebates and other benefits from merchants and other service providers since they will not be able to verify your identity and/or eligibility.
